In September, the state appealed the ruling of Judge Mark Pittman, who wrote in Andrews v. McCraw that Texas law prohibiting 18 to 20-year-old adults from carrying a weapon outside the home does not conform to the precedent set by the U.S. Supreme Court in N.Y. State Rifle & Pistol Ass’n, Inc. v. Bruen.
“To the extent that Texas’s statutory scheme … prohibits law-abiding 18-to-20-year-olds from carrying handguns for self-defense outside the home based solely on their age, this statutory scheme violates the Second Amendment,” Pittman wrote in his ruling.
The decision by the State of Texas to let the Andrews ruling stand was quickly celebrated as a victory by the Firearms Policy Coalition (FPC), which expanded on how the ruling will impact the constitutional rights of younger adults.
“We applaud Texas for doing the right thing and accepting the district court’s ruling against its law prohibiting 18-to-20-year-old adults from carrying firearms in public,” said Cody J. Wisniewski, FPC’s Senior Attorney for Constitutional Litigation.
“Not only do young adults have the same constitutionally protected right to bear arms as all other adults, they are also among the reasons we have a Second Amendment, Constitution, and Country in the first place.”
The Texan also spoke with Gun Owners of America State Director Wesley Virdell, who applauded the decision.
“We are grateful to the attorney general’s office for recognizing that the Second Amendment does not discriminate against age, and we believe this is a huge victory for the rights of all Texans,” Virdell said.
